Welcome to M.M.LaFleur! M.M.LaFleur, Inc. (“M.M.LaFleur”, “we”, “us” and “our”) is committed to protecting your privacy. We have prepared this Privacy Notice to describe to you our practices regarding the Personal Information (defined below) we collect from users of our website, https://mmlafleur.com/ (“Site”) and online services (“Services”). This Privacy Notice will apply whether you are a “Visitor” (which means that you simply browse the Services) or a “Registered User” (which means you have registered to use the Services). Visitors and Registered Users are individually referred to as a “User” and collectively as “Users”.

1. INFORMATION WE COLLECT

Personal Information” means information that allows someone to identify or contact you, including, for example, your name, address, telephone number, e-mail address, as well as any other non-public information about you that is associated with or linked to any of the foregoing data. “Anonymous Information” means information that is not associated with or linked to your Personal Information. Anonymous Information does not, by itself, permit the identification of individual persons.

Our primary goal in collecting information is to provide and improve our Services, to administer your use of the Services (including your Account, if you are an Account holder), and to enable you to enjoy and easily navigate our Services. The types of Personal Information we may collect (directly from you, from your devices, or from third-party sources) and our privacy practices depend on the nature of the relationship you have with M.M.LaFleur and the requirements of applicable law.

We collect the following Personal Information and Anonymous Information from the following sources:

a. Information You Provide to Us

We may collect information directly from you as follows:

i. Identifiers.We may collect Personal Information that can be used to identify you, such as your first and last name, e-mail and mailing addresses, telephone number, company name and password when you create an account to log in to our Site (“Account”). If you create an Account using your login credentials from one of your third-party services accounts, such as Facebook or Google (each a “Third-Party Account”), we will be able to access and collect your name and e-mail address and other Personal Information that your privacy settings on the Third-Party Account permit us to access. If you create an Account through the Site or one of your Third-Party Accounts, we may also collect your gender or date of birth.

ii. Ordering Information. We may collect Personal Information when you order products or services, such as sizing, fit, and style preference information. When you receive an order, we record what you keep and what you return.

iii. Transaction Information. When you sign up for an Account or when you order products or services on our Site, we or our third party payment provider will collect all information necessary to complete the transaction, including your name, credit card information, billing information and shipping information.

iv. Publicly Posted Content. When you post content (text, images, photographs, videos, messages, comments, or any other kind of content that is not your e-mail address) on our Services, the information contained in your posting will be stored in our servers and other users of the Services will be able to see it, along with any other information that you choose to make public. If you choose to submit content to any public area of the Site, such content will be considered “public” and will not be subject to the privacy protections set forth herein.

v. Information Stored in Your Account. We retain information on your behalf, such as your Wish List and other files and messages that you store using your Account.

vi. Feedback. If you provide us feedback or contact us via e-mail, we will collect your name and e-mail address, as well as any other content included in the e-mail, in order to send you a reply.

You agree that we are free to use the content of any communications submitted by you via the Services, including any ideas, inventions, concepts, techniques, or know-how disclosed therein, for any purpose including developing, manufacturing, and/or marketing goods or Services. We will not release your name or otherwise publicize the fact that you submitted materials or other information to us unless: (a) you grant us permission to do so; (b) we first send notice to you that the materials or other information you submit to a particular part of a Service will be published or otherwise used with your name on it; or (c) we are required to do so by law.

vii. Mobile Services. If you use our Services on your mobile device, we may collect your phone number and the unique device id number. When connecting to our Services via a service provider that uniquely identifies your mobile device, we may also receive this identification and use it to offer extended services and/or functionality.

viii. Location. If you tell us where you are (e.g., by allowing your mobile device to send us your location), we may store and use that information to provide you with location-based information and advertising. If you want to deactivate this feature, you can deactivate GPS on your mobile device.

ix. Surveys. When you participate in one of our surveys, we may collect additional profile information. All information collected from your participation in our surveys is provided by you voluntarily. We may use such information to improve our products, Site, and/or Services in any manner consistent with the policies provided herein.

x. Contests. If you participate in a sweepstakes, contest or giveaway on our Site, we may ask you for your e-mail address and/or home number (to notify you if you win or not). We may also ask for first and last names, and sometimes post office addresses to verify your identity. In some situations we may need additional information as a part of the entry process, such as a prize selection choice. These sweepstakes and contests are voluntary. We recommend that you read the rules for each sweepstakes and contest that you enter. All sweepstakes, contests or giveaway entry forms will provide a way for participants to opt-out of any communications that are not related to awarding prizes.

xi. Chat Feature. Our chat feature is powered by Kustomer, a third-party provider.  All chat conversations are by and between you and M.M.LaFleur employees.  Records of the chat, however, may be stored by us and/or Kustomer to improve our products, Site and/or Services in a manner consistent with the policies provided herein.

xii. Where Otherwise Stated. We may collect Personal Information at other points on our Site that state Personal Information is being collected.

b. Information Collected Automatically from Your Devices

We may collect information from you via technology, including automatically from your devices, as follows:

i. Log Files. As is true of most websites, we gather certain information automatically and store it in log files. This information includes IP addresses, browser type, Internet Service Provider (ISP), operating systems, date/time stamp, and clickstream data. We use this information to analyze trends, administer the Site, track Users’ movements around the Site, gather demographic information about our User base, and better tailor our Services to our Users’ needs.

ii. Cookies. Like many online services, we use cookies to collect information. “Cookies” are small pieces of information that a website sends to your computer’s hard drive while you are viewing the website. We may use both session Cookies (which expire once you close your web browser) and persistent Cookies (which stay on your computer until you delete them) to provide you with a more personal and interactive experience on our Site. This type of information is collected to make the Site more useful to you and to tailor the experience with us to meet your special interests and needs.

iii. Pixel Tags. We use “Pixel Tags” (also referred to as clear gifs, web beacons, or web bugs). Pixel Tags are tiny graphic images with a unique identifier, similar in function to Cookies, that are used to track online movements of users. In contrast to Cookies, which are stored on a user’s computer hard drive, Pixel Tags are embedded invisibly in web pages. Pixel Tags also allow us to send e-mail messages in a format users can read, and they tell us whether e-mails have been opened. We may use this information to reduce or eliminate messages sent to a user.

iv. Social Media Widgets. Our Website includes social media features, such as the Facebook “Like” button and LinkedIn, that might include widgets (such as the“Share This” button) or other interactive mini-programs. These features may collect your IP address and which page(s) you are visiting on our site and may set a cookie to enable the feature to function properly. These social media features are either hosted by a third party or directly on our Website. Your interactions with each of these features are governed by the privacy policy of the company providing it.

v. Analytics. We use Google Analytics, a service provided by Google, Inc. (“Google”), to gather information about how users engage with our Services. You can opt out of Google’s collection and processing of data generated by your use of the Services by going to http://tools.google.com/dlpage/gaoptout.

vi. Flash Cookies. When we post videos, third parties may use local shared objects, known as “Flash Cookies,” to store your preferences for volume control or to personalize certain video features. Flash Cookies are different from browser Cookies because of the amount and type of data and how the data is stored. Cookie management tools provided by your browser will not remove Flash Cookies. vii. Analytics Services and Interest-Based Advertising. In addition to the tracking technologies we place, other companies may set their own cookies or similar tools when you visit our Site. This includes third party analytics services, including but not limited to Google Analytics (“Analytics Services”), that we engage to help analyze how users use the Site, as well as third parties that deliver content or offers. We may receive reports based on these parties’ use of these tools on an individual or aggregate basis. We use the information we get from Analytics Services only to improve our Site and Services. The information generated by the Cookies or other technologies about your use of our Site and Services ( Analytics Information”) is transmitted to the Analytics Services. The Analytics Services use Analytics Information to compile reports on user activity. The Analytics Services may also transfer information to third parties where required to do so by law, or where such third parties process Analytics Information on their behalf. Each Analytics Services’ ability to use and share Analytics Information is restricted by such Analytics Services’ Terms of Use and Privacy Notice. By using our Site and Services, you consent to the processing of data about you by the Analytics Services in the manner and for the purposes set out above. We may also partner with ad companies to support our marketing efforts, including by providing you with ads better tailored to your likely interests. c. Information Collected from Third Parties

We may receive Personal and/or Anonymous Information about you from third party individuals or companies that promote or link to our Site, including as part of our rewardStyle affiliate program, or third party companies that provide services, including services related to marketing and social media, to M.M.LaFleur. We may add this information to the information we have already collected from you via our Site in order to improve the Services we provide.

d. Information Collected from You About Others

If you decide to send a third party a hint regarding any of your Wishlist items or to invite a third party to create an Account, we will collect your and the third party’s names and/or e-mail addresses in order to send an e-mail and follow up with the third party. We rely upon you to obtain whatever consents from the third party that may be required by law to allow us to access and upload the third party’s names and/or e-mail addresses as required above. You or the third party may contact us at dataprivacy@mmlafleur.com or call our privacy hotline at 1-888-377-5524 to request the removal of this information from our database.

2. HOW WE USE YOUR PERSONAL INFORMATION

a. General Use

In general, Personal Information you submit to us is used either to respond to requests that you make or to aid us in serving you better. We use your Personal Information in the following ways:

i. to deliver any products you order on our Site;

ii. to facilitate the creation of and secure your Account on our Site;

iii. to identify you as a User in our system;

iv. to provide improved administration of our Site and Services;

v. to provide the Services you request;

vi. to respond to questions, comments and other requests;

vii. to provide access to certain areas, functionalities, and features of our Services;

viii. to measure your interest in our products and Services;

ix. to develop new products and Services;

x. to process your orders and to process payment for products and services purchased;

xi. to process applications and transactions;

xii. to prevent potentially prohibited or illegal activities;

xiii. to enforce our terms;

xiv. to improve the quality of experience when you interact with our Site and Services;

xv. to send you a welcome e-mail to verify ownership of the e-mail address provided when your Account was created;

xvi. to send you administrative e-mail notifications, such as shipment notifications or security or support and maintenance advisories;

xvii. to respond to your inquiries related to employment opportunities or other requests, comments and questions and provide customer service;

xviii. to make telephone calls to you, from time to time, as a part of secondary fraud protection, to solicit your feedback, to discuss same-day delivery scheduling issues, or to address other time-sensitive matters; and

xix. to send newsletters, surveys, offers, and other promotional materials related to our Services and for other marketing purposes of M.M.LaFleur. We may provide you with these materials by phone, postal mail, facsimile, or email, as permitted by applicable law. Such uses include: tailoring content, advertisements, and offers; notifying you about offers, products, and services that may be of interest to you; providing Services to you and our sponsors; other purposes disclosed at the time that individuals provide Personal Information; and otherwise with your consent.

b. User Testimonials and Feedback

We often receive testimonials and comments from Users who have had positive experiences with our Services. We may occasionally publish such content. When we publish this content, we may identify our Users by their first and last name and may also indicate their home city. We obtain the User’s consent prior to posting his or her name along with the testimonial.

We may also post user feedback on the Site from time to time. We will share your feedback with your first name and last initial only. If we choose to post your first and last name along with your feedback, we will obtain your consent prior to doing so.

c. Creation of Anonymous Information

We may create Anonymous Information records from Personal Information by excluding information (such as your name) that makes the information personally identifiable to you. We use this Anonymous Information to analyze request and usage patterns so that we may enhance the content of our Services and improve Site navigation. We reserve the right to use Anonymous Information and aggregated and other de-identified information for any purpose and to disclose Anonymous Information to third parties in our sole discretion.

3. WHEN WE DISCLOSE OR SHARE YOUR PERSONAL INFORMATION

We disclose your Personal Information as described below and as described elsewhere in this Privacy Notice.

a. Third Parties Designated by You

When you use the Services, the Personal Information you provide will be shared with the third parties that you designate to receive such information, including your friends and relatives to whom you send Wishlist hints using the Site.

b. Users

We will share your Personal data with other Users solely for the purpose of providing the Services.

c. Third Party Service Providers

We may engage third-party services providers to work with us to administer and provide the Services including payment processing, shipping, and handling returns. These third-party services providers have access to your Personal Information only for the purpose of performing services on our behalf and are expressly obligated not to disclose or use your Personal Information for any other purpose. When you make a payment, the third-party payment processor (e.g., Braintree, Stripe, or PayPal) receives your full payment information and we receive only a funding confirmation.

d. Affiliates

We may share some or all of your Personal Information with our parent company, subsidiaries, joint ventures, or other companies under a common control (“Affiliates”), in which case we will require our Affiliates to honor this Privacy Notice.

e. Business Partners

We may share Personal Information with our business partners for our and their internal business purposes or to provide you with a product or service that you have requested. We may also provide Personal Information to business partners with whom we may jointly offer products or services, or whose products or services we believe may be of interest to you. In such cases, our business partner’s name will appear, along with us. We require our business partners to agree in writing to maintain the confidentiality and security of Personal Information they maintain on our behalf and not to use it for any purpose other than the purpose for which we provided it to them.

f. Marketing – Interest-Based Advertising

Through our Services, we may allow third-party advertising partners to set tracking tools (e.g., cookies) to collect information regarding your activities (e.g., your IP address, page(s) visited, time of day). We may also share de-identified information, as well as selected Personal Information, such as demographic information and past purchase history, with third-party advertising partners. These advertising partners may use this information (and similar information collected from other websites) for purposes of delivering targeted advertisements to you when you visit non-M.M.LaFleur related websites within their networks. This practice is commonly referred to as “interest-based advertising” or “online behavioral advertising.”. We may allow access to other data collected by the Site to facilitate transmittal of information that may be useful, relevant, valuable or otherwise of interest to you. If you prefer that we do not share your Personal Information with third-party advertising partners, you may opt out of such sharing at no cost by following the instructions in Section 8 below.

g. Marketing – Targeted Ads

We use your Personal Information to display ads and send you offers. We may also share your personal data with third party marketing partners for commercial purposes. This may include serving “targeted ads” based upon your individual interests and/or activities; further, we may disclose Personal Information that we collect or you provide to third parties (i) for the purpose of matching us with other potential customers who may have a profile or demographic characteristics similar to your own or (ii) to market or advertise their products or services to you if you have not opted out of such disclosures. If you prefer that we do not share your Personal Information for any of the foregoing purposes, you may opt-out of such sharing at no cost by following the instructions in Section 8 below.

h. Information Voluntarily Displayed to Other Users

The content you post to the Site may be displayed on the Site. Other users of the Site may be able to see some information about you, such as your name if you submit a review. We are not responsible for the privacy practices of other users who view and use the posted information.

i. Corporate Restructuring

We may share some or all of your Personal Information in connection with or during negotiation of any merger, financing, acquisition or dissolution transaction or proceeding involving sale, transfer, divestiture, or disclosure of all or a portion of our business or assets. In the event of an insolvency, bankruptcy, or receivership, Personal Information may also be transferred as a business asset. If another company acquires our company, business, or assets, that company will possess the Personal Information collected by us and will assume the rights and obligations regarding your Personal Information as described in this Privacy Notice.

j. Other Disclosures

Regardless of any choices you make regarding your Personal Information (as described below), M.M.LaFleur may disclose Personal Information if it believes in good faith that such disclosure is necessary to (i) comply with law enforcement or national security requests and legal process, such as a court order or subpoena; (ii) respond to your requests; (iii) protect your, our or others’ rights, property, or safety; (iv) to enforce our policies or contracts; (v) to collect amounts owed to us; (vi) when we believe disclosure is necessary or appropriate to prevent physical harm or financial loss or in connection with an investigation or prosecution of suspected or actual illegal activity; or (vii) if we, in good faith, believe that disclosure is otherwise necessary or advisable.

4. THIRD PARTY WEBSITES

Our Site may contain links to third party websites. When you click on a link to any other website or location, you will leave our Site and go to another site, and another entity may collect Personal Information or Anonymous Information from you. We have no control over, do not review, and cannot be responsible for these outside websites or their content. Please be aware that the terms of this Privacy Notice do not apply to these outside websites or content, or to any collection of your Personal Information after you click on links to such outside websites. We encourage you to read the privacy policies of every website you visit. The links to third party websites or locations are for your convenience and do not signify our endorsement of such third parties or their products, content, or websites.

5. DATA RETENTION

We retain your personal data while you have an account with us and while you continue to use or visit our site. We will retain your personal data for as long as it is reasonably necessary for the purposes set out in this Privacy Policy, considering the time period reasonably necessary to: provide our services to you; exercise the choices and rights you have requested; comply with our contractual obligations; enforce our terms for use; and comply with legal and regulatory requirements.

6. CALIFORNIA PRIVACY NOTICE

a. “Legal Categories” of Personal Information

California law requires us to tell you about the personal information we collect about you in a certain way – specifically, we need to tie it back to “legal categories” of personal information that are listed in the law.  To do this, we bundled up the information we gave you above in this Privacy Notice and matched the different types of personal information we collect about you with the legal category.  Please note that certain pieces of personal information may fall into more than one of these categories.

To make things easier to understand, we’ve put this information in a chart that shows you five things:

i. The legal category of personal information,

ii. Examples of the types of personal information included in each legal category,

iii. The source(s) from which we collect this type of personal information,

iv. The purpose(s) for why we collect and use your personal information for each legal category; and

v. The business purposes for which we share your personal information and with whom.

We’ve included these things in the California Privacy Chart at the end of this Privacy Notice. At the end of the California Privacy Chart, we have also included a list of Information We Disclose for a Business Purpose.

b. Your Rights and Choices in the U.S. (Including California)

For all personal information that we collect about you, you may have the following rights or choices that we will accommodate where your requests meet legal and regulatory requirements and do not risk making our other data less secure or changing our other data.  You may also designate an authorized agent to make a request on your behalf.

i. Know, Erase: You may have the right to know what information is being collected about you, to access your personal information, to receive a copy of your information, and to know whether your personal information is disclosed and to whom.  You also may request that we erase your information.

All users may delete their user account by contacting us using the methods in the “Questions and Feedback” section below. All other Personal Information may be reviewed, updated or deleted by contacting us or by you editing your Account information via the Services. We will use commercially reasonable efforts to honor your request. We may retain an archived copy of your records as required by law or for legitimate business purposes.

ii. Correct: If you believe that any of your personal information collected by us is inaccurate, you may have the right to have that information corrected, depending upon the nature of the personal information and the purpose for its processing.

iii. Opt Out of Sale, Targeted Advertising, or Profiling: You may have the right to ask us not to sell your personal information, to ask us not to use your personal information for targeted advertising, and to ask us not to use your personal information for profiling.  We do not sell your personal information, and we do not use it for profiling or targeted advertising, but if you wish to make a request using the methods in the “Questions and Feedback” section below, we are happy to confirm that we do not sell your personal information or use it for targeted advertising or profiling.

iv. Access: If you would like to request that we provide a copy of your information to you, please contact us using the methods in the “Questions and Feedback” section below.

v. Portability: If you would like us to send your personal information to another business or organization, please contact us using the methods in the “Questions and Feedback” section below.

vi. Non-Discrimination:  You have the right not to receive discriminatory treatment by M.M.LaFleur because you exercise your privacy rights.  If you have any questions, please contact us using the methods in the “Questions and Feedback” section below.

c. Request Procedure

i. How to Make a Request. If you would like to make a request, please contact us using the information in the “Questions and Feedback” section below.  Please include your full name, email address, and a detailed description of your data request (including the specific type of request you would like to make: request to know, erase, opt out of sale, or access).

ii. Responding to Requests. Your requests will be processed in line with applicable laws. Although we make good faith efforts to provide individuals with access to their Personal Information, there may be circumstances in which we are unable to provide access, such as where the information contains legal privilege, would compromise others’ privacy or other legitimate rights, where the burden or expense of providing access would be disproportionate to the risks to the Individual’s privacy in the case in question, or where the information is commercially proprietary. If we determine that access should be restricted in any particular instance, we will provide you with an explanation of why that determination has been made and a contact point for any further inquiries.

iii. Verifying Your Identity. To protect you and your information, we may ask you to confirm certain information before we honor your request.  For example, if you make a request, we will ask you to confirm your email address and phone number.  For certain requests, we will use a combination of your email address, phone number, zip code, and/or birth date to verify your identity, so that we can help protect your information.  If you designate an authorized agent to make a request on your behalf, we may require you to verify your identity and provide the authorized agent’s identity and contact information to us.

7. EUROPEAN PRIVACY NOTICE

This section of our Privacy Notice applies to residents of the European Economic Area (EEA).

a. International Data Transfers

M.M.LaFleur primarily stores the personal information we collect in the United States.  To facilitate M.M.LaFleur’s  global operations, staff who work for M.M.LaFleur and/or our service providers may transfer and access such personal information from locations around the world.  This will involve transferring your personal information outside the EEA.

We will take all steps reasonably necessary to ensure that your personal information is treated securely and in accordance with this Privacy Notice.

Whenever we transfer your personal information out of the EEA, we will ensure one of the following safeguards is implemented:

i. We will only transfer your personal information to countries that have been deemed to provide an adequate level of protection for personal information by the European Commission; or

ii. We may use specific contracts approved by the European Commission which give personal information the same protection it has in Europe; or

iii. We will ensure there is some other protection in place which has been approved by the European Commission as giving personal information the same protection it has in Europe.

b. Your Privacy Rights

Under certain circumstances, individuals within the European Economic Area have rights under data protection laws in relation to their personal information as set out below:

i. Request access to your personal information, to receive a copy of the personal information we hold about you and to check that we are lawfully processing it.

ii. Request correction of the personal information that we hold about you if it is inaccurate or incomplete.

iii. Request erasure of your personal information where there is no good reason for us continuing to process it.  You also have the right to ask us to delete or remove your personal information where you have successfully exercised your right to object to processing (see below), where we may have processed your information unlawfully, or where we are required to erase your personal information to comply with local law.

iv. Object to processing of your personal information where we are relying on a legitimate interest (or those of a third party) and you feel it impacts on your fundamental rights and freedoms.  You also have the right to object where we are processing your personal information for direct marketing purposes. In some cases, we may demonstrate that we have compelling legitimate grounds to process your information which override your rights and freedoms.

v. Request restriction of processing of your personal information (a) if you want us to establish the data’s accuracy; (b) where our use of the data is unlawful but you do not want us to erase it; (c) where you need us to hold the data even if we no longer require it as you need it to establish, exercise or defend legal claims; or (d) you have objected to our use of your data but we need to verify whether we have overriding legitimate grounds to use it.

vi. Request the transfer of your personal information to you or to a third party in a structured, commonly used, machine-readable format.  Note that this right only applies to automated information which you initially provided consent for us to use or where we used the information to perform a contract with you.

vii. Complain to a government regulator if you are not satisfied with our response, depending on your location.

c. Legal Bases For Processing

This section describes some of the legal bases we rely on to process your personal information. We may process your personal information for more than one legal basis depending on the specific purpose(s) for which we are using your personal information, including the following legal bases:

i. Contracts. Where we need to perform the contract we are about to enter into or have entered into with you, including to provide you products or services.

ii. Legitimate Interests. Where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests. The following are non-exhaustive examples of where M.M.LaFleur relies on legitimate interest to process personal information:

1. M.M.LaFleur has a legitimate interest in processing personal information relating to our existing customers in order to manage our business relationship and provide communications and information that may be of interest, including marketing communications.

2. M.M.LaFleur has a legitimate interest in using cookies as outlined in this Privacy Notice.

iii. Legal Obligations. Where we need to comply with a legal or regulatory obligation.

iv. Consent. Where you have affirmatively given your consent to the processing of your personal data for one or more specific purposes. This basis will only be relied upon only after you have been notified of the data controller’s identity, what kind of data will be processed, how it will be used, and the purpose of the processing operations and only if your consent has been freely given and is specific and unambiguous. You also have the right to withdraw your consent at any time using any of the methods described in Section 8 below.

8. OPTING OUT, RESTRICTING USE OR DISCLOSURE, AND WITHDRAWING CONSENT

We offer you choices regarding the collection, use and sharing of your Personal Information, and we’ll respect the choices you make. Please note that if you decide not to provide us with the Personal Information that we request, you may not be able to access all of the features of the Services. You have the right to opt out of certain uses and disclosures (or to withdraw your affirmatively given consent where the law does not permit default opt-in) of your Personal Information.
